Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client") and Cyberwix ("we," "us," or "our"), governing your use of our website at cyberwix.com and your engagement of our web design, branding, and related services.

By submitting a contact form, requesting a quote, or entering into a service agreement with Cyberwix, you acknowledge that you have read, understood, and agree to be bound by these Terms.

Project delays caused by late content submission or unresponsiveness from the Client are not the responsibility of Cyberwix.

Intellectual Property

Upon receipt of full payment, you will own the final website design and logo files delivered to you. Cyberwix retains the right to:

Any third-party assets (stock images, fonts, icons, plugins) used in your project are subject to their respective licenses. We will only use properly licensed assets in client work.

You represent and warrant that all content you provide to Cyberwix for use in your project does not infringe the intellectual property rights of any third party.

Revisions and Edits

The number of revision rounds included in your package will be specified in your project agreement. Requests for edits beyond the agreed scope may be subject to additional fees, which will be communicated in advance.

Monthly hosting plans ($25/month) include ongoing minor content updates. Major redesigns or additional pages are quoted separately.

Hosting and Uptime

For clients on our monthly hosting plan, we will make reasonable efforts to maintain website availability. However, we do not guarantee 100% uptime and are not liable for service interruptions caused by third-party hosting providers, domain registrars, or other factors outside our control.

Clients who discontinue monthly hosting services will be provided their website files upon request. Domain ownership remains with the client.

Limitation of Liability

Cyberwix's total liability to you for any claims arising from our services shall not exceed the total amount paid by you to Cyberwix in the three (3) months preceding the claim.

We are not liable for any indirect, incidental, consequential, or punitive damages, including lost profits or business opportunities, arising from the use or inability to use our services.

We do not guarantee specific business results, search engine rankings, or revenue outcomes from websites or Google Business Profiles we create or manage.

Termination

Either party may terminate ongoing services (such as monthly hosting or Google Business management) with 30 days' written notice via email. Upon termination:

Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of San Bernardino County, California.

Changes to These Terms

We reserve the right to update these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. Continued engagement of our services after any changes constitutes your acceptance of the updated Terms.
